Restricted areas

Dog fouling

If a dog fouls?within the restricted area, at any time, and the person who is in charge of the dog fails to remove the faeces or place it in a bin that person shall be guilty of an offence unless

  • The person has a reasonable excuse for failing to do so.
  • The owner, occupier or other person or authority having control of the restricted area has consented (generally or specifically) to the failing to do so.
  • The person is unaware of the defecation because of not being in the vicinity or otherwise. Not having a device or other suitable means of removing the faeces is not a reasonable excuse for failing to remove the faeces. The person in charge of the dog must produce a device or other suitable means of removing dog faeces at an authorised officer request. If the person is unable to provide this then and offence will have been committed unless the person has a reasonable excuse for not doing so.

Dogs on leads

A person in charge of a dog shall be guilty of an offence if, at any time, they do not comply with a direction given to them by an authorised officer to put and keep the dog on a lead in the restricted area unless

  • The person has a reasonable excuse for failing to do so.
  • The owner, occupier or other person or authority having control of the restricted area has consented otherwise.

An authorised officer may only request a dog to be on a lead if it is reasonably necessary to prevent a nuisance or behaviour by the dog that is likely to cause annoyance or disturbance to any other person, or to a bird or another animal.

Dog exclusion area

Dogs must not enter the exclusion area. If a person in charge of a dog takes a dog into this area they are guilty of an offence unless

  • The person has a reasonable excuse for doing so.
  • The owner, occupier or other person or authority having control of the restricted area has consented.

Multiple dog walking

No more than 4 dogs are allowed to be controlled by?1 person in the restricted area unless??

  • The person has a reasonable excuse for doing so.
  • The owner, occupier or other person or authority having control of the restricted area has consented.?

Exemptions

The following exemptions apply.

  • If you have a disability and have a guide or assistance dog.
  • If you are training an assistance dog in an official capacity.
  • You have a dog used by the Police or other agencies permitted by the Council for official purposes.

Fixed penalty

The Police or a council enforcement officer may issue a fixed penalty notice of ￡80 to anyone believed to have committed an offence.
